Prosecuted to Judgment a Breach of Contract and Labor Code Case
The Firm successfully prosecuted a breach of contract and Labor Code claim on behalf of a professional sports executive against his former employer resulting in a seven-figure arbitration award—as well as an attorneys’ fee award. As part of this case, the Firm also successfully defended the ex-employer’s cross-complaint asserting breach of contract and fiduciary duty claims. That cross-complaint sought a seven-figure compensatory damage award—as well as punitive damages—against the Firm’s client. The case was a binding JAMS arbitration held before a retired judge.
Prosecuted to Judgment a Breach of Fiduciary Duty Case
The Firm successfully prosecuted to judgment a breach of fiduciary duty case arising from the attempted theft of church real property valued in excess of $2 million. The judgment in favor of the church congregation included the return of the church real property—as well as a six-figure punitive damage award against the lead defendant. The case was venued in San Mateo County Superior Court.
Prosecuted to Judgment a Trade Secret and Breach of Contract Case
The Firm successfully prosecuted to judgment a trade secret and breach of contract case following a three week jury trial. The judgment on behalf of the corporate client included a damage award, as well as an attorney’s fee award. The case was venued in San Joaquin County Superior Court.
Defended Corporate Clients in a Multi-Party Fraud Case
The Firm successfully defended corporate clients in a multi-party fraud and contractual interference case. The trial court’s ruling dismissing several of the claims against the corporate clients appears at Andrew Smith Co. v. Paul’s Pak, Inc., 754 F. Supp. 2d 1120 (N.D. Cal. 2010). The case successfully settled after opening statements. The case was venued in the Federal District Court for the Northern District of California.
Prosecuted to Judgment a Declaratory Relief and Specific Performance Action
The Firm successfully prosecuted to judgment a declaratory relief and specific performance action following a three week bench trial. The corporate client was awarded ownership of real property valued in excess of $2 million. The decision was affirmed on appeal: Central Coast Baptist Church v. First Baptist Church of Los Lomas, 171 Cal. App. 4th 822 (2007). The case was venued in Monterey County Superior Court.
Prosecuted a Wrongful Termination Action Against an Auto Dealership
The Firm successfully prosecuted to judgment a wrongful termination action against an auto dealership following a three week jury trial. The case was venued in San Joaquin County Superior Court.
Prosecuted a Legal Malpractice Action
The Firm successfully prosecuted a legal malpractice action to recover funds on behalf of a local church. The case successfully settled on the morning of trial. The case was venued in Santa Clara County Superior Court.
Defended Against Claims of Contractual Interference and Fraud
The Firm successfully defended a corporate client in a six week jury trial in Sacramento against claims of contractual interference and fraud. The case successfully settled shortly before the case was given to the jury for deliberations. The case was venued in Sacramento County Superior Court.
Prosecuted an Embezzling Former Employee
The Firm successfully prosecuted an embezzling former employee and was able to achieve through negotiations and settlement with the former employee and the client’s insurance companies a significant recovery.
Defended $4 Million Breach of Contract and Fraud Claims
The Firm successfully defended a corporate client against claims of breach of contract and fraud. The case successfully settled—as well as preserved an ongoing business relationship. The case was venued in the Los Angeles JAMS office.
Defended Wrongful Termination and Whistleblower Claims
The Firm successfully defended a corporate client against wrongful termination and whistleblower claims seeking in excess of $8 million dollars. The case was litigated for over two years, and ultimately the case was dismissed with prejudice without any settlement payment by the client. The case was venued in Santa Clara County Superior Court.
Defended Breach of Contract Claim
The Firm successfully defended a corporate client against breach of contract claims. The plaintiff dismissed the case after depositions, and the Firm’s offer to waive a malicious prosecution claim. The client made no settlement payment to resolve the case. The case was venued in Santa Clara County Superior Court.
